Acceptance of Terms
By accessing and using the website of The Legacy Foundation ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website. Certain programs, donations, ticket transfers, family participation, and events are also governed by separate terms presented at the relevant point of use.
Use of Website
You agree to use our website only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use of the website. Prohibited activities include transmitting harmful content, attempting unauthorized access, or interfering with website functionality.
Donations
All monetary donations are final and non-refundable unless otherwise required by law. Donations are processed securely through our payment processor. The Legacy Foundation is a 501(c)(3) nonprofit organization (EIN: 20-4557510). A donation may be deductible only to the extent allowed by applicable law; donors are responsible for determining their own tax treatment and should consult a qualified tax advisor.
Seat Forward and Program-Specific Terms
Seat Forward ticket donations are governed by the Ticket Donation Terms. Recipient and family participation is governed by the Recipient & Family Participation Terms, event-specific rules, and any required consent or waiver. If a program-specific agreement conflicts with these website Terms of Service for that program transaction, the program-specific agreement controls for that transaction.
Intellectual Property
All content on this website, including text, graphics, logos, and images, is the property of The Legacy Foundation and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
Disclaimer of Warranties
This website is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, The Legacy Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website. This general website limitation does not enlarge or override narrower participant risk language, safeguarding duties, privacy commitments, or program-specific terms.
Changes to Terms
We may update these Terms of Service by posting a revised version with a new update date. Changes apply prospectively unless applicable law requires otherwise. The version of any program-specific terms accepted for a donation, allocation, or outing continues to govern that transaction unless the accepted terms expressly permit an update or applicable law requires otherwise.
Governing Law and Forum
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Subject to any non-waivable right or jurisdictional rule, any action arising from these Terms must be brought in the state or federal courts located in New York County, New York, and each party consents to that jurisdiction and venue. Nothing in these Terms limits a right that cannot lawfully be waived.
